1. Agreement to these terms

These Terms of Service (“Terms”) are a binding agreement between you and BuildMapper (“BuildMapper,” “we,” “us”) governing your access to and use of our website and application (the “Service”). By creating an account or using the Service, you agree to these Terms. If you are using the Service on behalf of a company, you represent that you are authorized to bind that company.

2. The Service

BuildMapper aggregates and scores construction-permit records and related business information from official municipal and public-records sources, and provides tools to help you find, research, and reach relevant projects. The Service is a sales-intelligence and productivity tool. It does not provide legal, financial, or professional advice.

3. Accounts and eligibility

You must be at least 18 years old and provide accurate account information. You are responsible for safeguarding your credentials and for all activity under your account. Notify us promptly at info@buildmapper.com if you suspect unauthorized use.

4. Acceptable use

You agree to use the Service lawfully and only for legitimate business purposes. You will not resell, scrape, or redistribute the data except as expressly permitted; reverse-engineer or disrupt the Service; misuse contact information; or use the Service to send unlawful, deceptive, or unsolicited bulk communications.

When you contact people or businesses using information from the Service, you are solely responsible for complying with all applicable laws, including Canada’s Anti-Spam Legislation (CASL), telemarketing rules, and equivalent laws in your jurisdiction. You are responsible for obtaining any consent required and for honouring opt-out requests.

5. Data accuracy

Permit and business information is sourced from third-party and public records and is provided “as is.” We work to keep it useful and current, but we do not guarantee that any record, score, contact, or estimate is accurate, complete, or up to date. You should independently verify information before relying on it. Scores and timing windows are estimates, not guarantees of outcomes.

6. Plans, billing, and cancellation

The Service offers a free plan and paid subscription plans. Pricing and plan features are described on our pricing page and may change with notice. Paid plans renew on a recurring basis until cancelled. You may cancel at any time, effective at the end of your current billing period; fees already paid are non-refundable except where required by law. We will give notice of material changes to fees.

7. Intellectual property

The Service, including its software, design, and content (excluding third-party permit data and your own content), is owned by BuildMapper and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service while your account is in good standing. You retain ownership of content you create in the app and grant us the limited rights needed to operate and provide the Service to you.

8. Third-party services

The Service relies on third-party providers for hosting, authentication, email, and optional integrations. Your use of any integration (for example, signing in with Google) is also subject to that provider’s terms. We are not responsible for third-party services we do not control.

9. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that it will produce any particular sales result.

10. Limitation of liability

To the fullest extent permitted by law, BuildMapper and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill. Our total liability for any claim relating to the Service will not exceed the amount you paid us for the Service in the twelve months before the event giving rise to the claim.

11. Indemnification

You agree to indemnify and hold BuildMapper harmless from claims, damages, and expenses arising out of your use of the Service, your content, your outreach to third parties, or your violation of these Terms or applicable law.

12. Termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access if you violate these Terms or use the Service in a way that risks harm to others or to us. Provisions that by their nature should survive termination will survive.

13. Governing law

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable there, without regard to conflict-of-laws rules. The courts located in British Columbia will have exclusive jurisdiction, subject to any mandatory consumer-protection rights you may have where you live.

14. Changes to these terms

We may update these Terms from time to time. When we make material changes, we will update the date above and, where appropriate, notify you. Your continued use of the Service after an update means you accept the revised Terms.
